Usage rules of the CIP-Pool

Administration, usage and cost regulations for the computer centre of the Faculty of Law of the Georg-August University of Göttingenfrom 22 April 2002

§ 1 Administration and management
(1) The computer centre is a facility of the law seminar of the Georg-August-Universität Göttingen
(2) The managing head of the law seminar is responsible for observation of the tasks intended for the computer centre, for selection and appropriate use of employees and for use of the materials. He may charge another person with performance of these tasks.

§ 2 Purpose
The computer centre is mainly available for training purposes It may be used for scientific or other official purposes in the scope of its free capacities.

§ 3 Users
(1) The usage permit may be procured by any student or employee of the Georg-August-Universität Göttingen. Full usage scope may be limited (s. § 7).
(2) The usage permit is granted upon written application if the applicant participates in a course that is offered in the scope of the purpose of the computer centre or if he has participated in an approximately one hour long introduction for information on the technical requirements of use of the computer centre. The usage permit is granted with assignment of a password for network use.
(3) The user bears sole responsibility for any services used with his user ID.
(4) The usage permit is usually limited to the respective semester. After expiration of the usage permit, extension must be requested. From case to case, a shorter time limitation may be applied.

§ 4 Access control
Persons authorised to usage legitimate at a computer of the computer centre with their assigned user names and password. The password must be changed at regular intervals. Every user is responsible for keeping his password secret.

§ 5 Supervision
(1) The computer centre generally must only be used when a responsible supervisor is present. The managing head of the law seminar makes decisions on exceptions from case to case.
(2) The supervisor is responsible for access control, switching the network system on and off, supervision and operation of printers and scanner, protection of the devices, data carriers, software manuals and other books from theft or damage and for compliance with the user rules.
(3) While and as far as staff is not specifically available for support and supervision of the computer centre, employees of the Faculty of Law or doctoral students may be charged with supervision tasks.

§ 6 Usage times
(1) The computer centre is available to the users during the opening hours unless there are any special lectures taking place there.
(2) The opening hours are determined by the managing head of the law seminar according to the available supervision capacities and the usual opening hours of the law seminar and published together with the times reserved for special lectures.
(3) For members of other faculties of the Georg-August-Universität Göttingen, computer workplaces may be provided for lectures if proper supervision and professional operation of the devices are warranted.
(4) Computer workplaces for lectures must be reserved in the computer centre in a timely manner. Reservation is valid subject to the consent of the managing head of the law seminar.

§ 7 Type and scope of use
(1) Use of the devices and programmes is free of charge.
(2) Use of the internet services (in particular email, news, ftp and world wide web) can only be granted to students able to document valid access via the internet hotline of the Georg-Ausust-Universität Göttingen and members of the law seminar. This documentation must be provided every semester unprompted.
(3) The online law databases are available to all students and members of the law seminar subject to technical possibilities.
(4) Own software must not be used (e.g. due to danger of virus transfer); this shall particularly apply for other operating systems and computer games.
(5) To achieve best computer utilisation, preliminary work for which a computer is not required is to be performed outside of the computer workplace. Place reservations are only permissible for professors or their employees to prepare for lectures. If the workplace is left for more than 15 minutes, it can be re-assigned. The risk of data loss is the user's risk.
(6) Use of the computer provided for special layout tasks and on which documents can be scanned to convert them into electronic form must be indicated to the supervisor in time. Individuals may be granted priority by the supervisor in justified cases.

§ 8 Use of the programmes
(1) Users may load the programmes installed on the central unit (server) and the local hard disc into the computer's RAM and run them. Copying these programmes is not permissible (cf. § 10).
(2) If this provision is not observed, the user in question will be immediately blocked.

§ 9 Data safety
(1) In the scope of the available capacity, the user may store data on the server. For this, the user receives access to a personal profile stored on the server by signing on to the network. Own data may be stored only in the directory "Eigene Dateien" or drive "H:". When the capacity threshold is reached, such data may be deleted without previous information.
(2) if the user authorisation expires at the end of the semester and is not extended, all data in the personal user profile may be deleted without information at the end of the next semester.
(3) Data generally must not be saved on the local hard disc of the work computer. Creation of sub-directories in the root directory also is not permissible. Manipulation of other files and directories and the files installed there is not permissible.
(4) The user must log off of the computer properly. If this is not done, the user is locked temporarily for his own protection by the supervisor. The lock can only be revoked personally.

§ 10 Observation of copyright
The software used in the computer centre is copyright-protected purs. to § 2 para 1 no. 1, para 2 UrhG in the version from 8.5.1998 (BGBl. I, p. 902). The same applies for accessing customer manuals and operating instructions. Any reproduction is prohibited. Violation of these obligations may trigger personal liability purs. to §§ 97 et seqq UrhG and punishment pursuant to § 106 UrhG. The law seminar and the University of Göttingen are relieved from liability purs. to 100 UrhG if a user violates a copy-right protected work.

§ 11 Use of connected databases
(1) Any database connections set up in the computer centre (e.g. juris) may be used in the scope of the available capacities. Only information processing orders that are directly connected to research, teaching and study tasks may be performed and that are approved according to the usage conditions of the respective database operator and any special contracts with the law seminar of the University of Göttingen.
(2) Research is performed independently by every single user.

§ 12 Consumables
(1) Floppy discs are to be provided by the user. Only high-quality branded floppy discs must be used to warrant the operational safety of the devices.
(2) Printer paper, ink and toner are provided and installed in the computer centre. Every user shall pay the rounded purchasing costs price per page as indicated in § 13 for use of consumables and paper consumption.
(3) When leaving the room, the user shall present the printed pages unprompted and pay for the costs incurred at once. This shall also apply for misprints and interrupted print orders triggered by the user. The supervisor shall be authorised to retain the printed pages until payment of the costs. If printed pages are not collected, the usage authorisation shall be revoked.

§ 13 Costs
(1) When using the ink jet printer, EUR 0.15 shall be payable for every started printed page in colour, and EUR 0.05 shall be payable for every started printed page in black/white.
(2) When using the laser printer, 0.05 shall be payable for every started printed page.

§ 14 Liability
(1) The Georg-August-Universität Göttingen and the law seminar do not assume any liability for function of the devices in the computer centre.
(2) Every user is responsible for his own data backups. Liability of the University of Göttingen or of the law seminar in case of data loss or change due to technical defects or negligent incorrect operation by the supervisor shall be excluded.

§ 15 Data privacy
(1) Personal data that permit conclusions on determinable persons usually must not be stored or processed in the computer centre.
(2) Every user is responsible for observing the Federal data Privacy Act and the Lower Saxony Data Privacy Act.

§ 16 Order in the rooms
(1) The users shall align their conduct so that no other user is impaired or disturbed more than unavoidable in the circumstances and that the operating safety of the system is warranted.
(2) It is not permissible to independently adjust the devices and to make any changes to the devices or cables.
(3) Strict silence is to be maintained in the rooms; if any other users are present, mutual explanations are only permitted in whispers, if at all. This shall also apply regarding use of mobile phones. Smoking, eating and drinking in the rooms is prohibited. (4) The rooms must not be entered with any coats, umbrellas, luggage, folders or bags.
(5) The supervisor's instructions must be observed. When leaving the rooms, the user shall show any objects taken along to the supervisor unprompted and permit inspection if applicable.

§ 17 Disciplinary measures
(1) by application for granting of a usage permit, the user subjects himself to these usage regulations.
(2) The supervisor may require from each user that he prove his identity by picture ID, as well as presentation of the content of containers.
(3) The supervisors may exclude persons who do not have the technical knowledge to handle the devices from use of the devices and remove persons from the rooms if they disturb the order in the computer centre.
(4) The managing head of the law seminar may temporarily or permanently exclude persons who violate the usage regulations from use of the computer centre.
